Terms.
These terms govern your use of Hypothesisly. By accessing or using the product you agree to them. They’re written plainly; the binding version will be reviewed by counsel before general availability.
Who can use Hypothesisly
Hypothesisly is for business use. You must be at least 16, able to enter into a contract, and — if you’re using it for an organisation — authorised to act on its behalf. You’re responsible for keeping your account credentials secure and for activity under your account.
The service
Hypothesisly audits a website and produces ranked, falsifiable A/B-test hypotheses. It is an analysis tool: it does not run experiments, does not modify your site, and does not guarantee any particular outcome or uplift. You decide what to test, and you run the tests using your own tools.
Your responsibilities & acceptable use
- Only submit sites you own or are authorised to audit. If you audit on behalf of a client, you confirm you have permission to do so.
- Don’t reverse-engineer, resell, sublicense, or white-label the service except under a separate written agreement with us.
- Don’t use the service to break the law, infringe others’ rights, or attempt to disrupt or gain unauthorised access to our systems.
- Don’t submit unlawful content, or anything you don’t have the right to share with us.
Your data & content
You keep ownership of the data you submit and of the hypotheses and outputs generated for you. You grant us the limited licence needed to process that data to provide the service. We handle personal data as described in our Privacy Policy.
Our intellectual property
We own the Hypothesisly platform, software, prompts and model configuration, and the underlying knowledge base. These terms don’t transfer any of our intellectual property to you beyond the right to use the service.
Third-party services
When you connect services such as Google Analytics 4 or Microsoft Clarity, or book a demo, your use of those services is governed by their own terms. We’re not responsible for third-party services.
Early access
During early access, features may change and availability is not guaranteed. We may modify, suspend, or discontinue parts of the service, and we’ll give reasonable notice of material changes that affect you.
Plans & billing
Hypothesisly is free during early access. Pricing and billing terms will be published here before paid plans launch.
Disclaimers
The service is provided “as is” and “as available”. Hypotheses are evidence-based recommendations, not guarantees of results, and they are not professional, legal, or financial advice. To the fullest extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, or consequential losses, or for lost profits, revenue, or data. Our total liability for any claim is limited to the greater of the fees you paid us in the three months before the claim or, during the free early-access period, a nominal amount. Nothing here limits liability that can’t be limited by law.
Indemnity
You agree to indemnify us against claims arising from your misuse of the service, your breach of these terms, or your submission of sites or data you weren’t authorised to submit.
Termination
You can stop using the service at any time. We may suspend or end access if you breach these terms, or where needed to protect the service or other users. On termination, the export-and-deletion process in our Privacy Policy applies, and the terms that should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except where mandatory local law where you live provides otherwise. Nothing in these terms removes the consumer or data-protection rights you have under the mandatory law of your own country or state — including in the UK, the EU, and the US.
Changes
We may update these terms; if changes are material we’ll update the date above and, where appropriate, notify you. Continued use after a change means you accept it.
